Food Experts S.L. (“FEXP”) takes the protection of your personal data very seriously.

FEXP is a global organisation, and it is important to us that the personal information of our users is processed in accordance with the EU General Data Protection Regulation (GDPR), even if the users are not based in the European Union (EU).

The GDPR, applicable from 25 May 2018, strengthens the fundamental rights of citizens in the digital age. Under the GDPR, you have the right to know what personal data we store, and you may ask us to correct it or even delete it at any time.

1. Scope

This privacy policy describes how FEXP collects, processes and protects personal data about you, how we use and protect this data, and your rights in relation to this information. This privacy policy is governed by Spanish law. Accordingly, for the drafting and interpretation of this legal text, the language of this privacy policy will be Spanish, and the versions in all other languages are translations of this document.

This privacy policy applies to all personal data collected or processed by Food Experts, including data captured by the FEXP online platform located at www.food-experts.com (the “FEXP Platform” or the “Platform”).

Personal data means any information relating to an identified or identifiable natural person, such as their name, address, email addresses or user behaviour.

2. Summary

What do we use your personal data for?	We use the information you provide to us to manage and maintain the business relationship, provide you with the services and send you news and information.
Why do we use your personal data?	We use your personal data to manage and maintain the business relationship, comply with our contractual obligations (that is, provide you with the service), comply with our legal obligations and pursue the legitimate interests provided for by law. You agree to receive communications, information and newsletters about products and services, by post or electronically, from FoodExperts, even after the business relationship has ended. If you do not wish to receive them, please let us know at dpo@food-experts.com. If you are a registered user of the FEXP Platform: you agree to be sent communications from other registered users and from FEXP, as this is necessary to provide the services and to fulfil the Platform’s objective of facilitating communication and data exchange between registered companies and users. In addition, FEXP sends registered users newsletters, technical updates (for example, MRL changes) and other information. If you do not wish to receive them, change the settings for your notifications and alarms.
How long do we keep your personal data?	The data provided will be retained for as long as the business relationship continues or for the number of years necessary to comply with legal obligations. If you are a registered user of the FEXP Platform: contact details will be deleted from our systems for users deregistered more than six years ago. We will store all other contact details (for example, business contacts, the website contact template, etc.) until you request their deletion.
Who do we disclose your personal data to?	No data will be disclosed to third parties, except where there is a legal obligation or where this is necessary to provide you with the service (for example, in the case of sampling services, the company’s contact details will be disclosed to the sampling officers).
What are your rights?	You have the right to lodge a complaint with the Spanish Data Protection Agency (Agencia Española de Protección de Datos, AEPD). To exercise your rights of access, rectification and erasure of your data, restriction of its processing, data portability and/or objection, send a written communication to the controller: FOOD EXPERTS, S.L. 4. Categories of data

FEXP collects and processes different categories of personal data depending on the service you use.

Registered users of the FEXP Platform

When you register on the FEXP Platform, we collect your: username, password, first name, surname, work mobile phone number, work email address, work address, office telephone number, office fax number and the company you work for. If you provide us with additional information, such as a photo/avatar, we will also process this information.

When you contact us through our website contact form, we will collect your: name, email address and message.

Please note that FEXP may receive messages that require translation. In such cases, our employees use translation tools (for example, Google Translate) to process your enquiry. Therefore, please make sure that you do not enter any personal information in the message field of your enquiry.

Other business contacts

When you contact us by telephone, email, in person or through any other business contact, we will collect the information you provide to us. The information typically collected is your first name and surname, email address, telephone number and the company you work for, although other types of information provided by you may be collected.

5. Data storage

The FEXP Platform servers are located in the EU and are subject to EU regulations on personal data privacy. This excludes third-party services and content, on which we are unable to comment.

6. Purpose and lawful basis for processing

To the extent that FEXP must process any of your personal data to comply with a legal obligation or for the performance of a contract, we process your personal data on the basis of Article 6(1)(b) and (c) of the GDPR.

FEXP needs to process your personal data in order to manage and maintain the business relationship, comply with our contractual obligations (that is, provide you with the service), comply with our legal contractual obligations and pursue the legitimate interests provided for by law.

The lawful basis for processing your personal data is a service agreement, that is, Article 6(1)(b) of the GDPR. If you submit additional data on the basis of your consent, the lawful basis for processing is Article 6(1)(a) of the GDPR.

If you submit an enquiry to us using the contact form, FEXP needs to process your personal data in order to respond to your request, manage and maintain the business relationship, comply with our contractual obligations (that is, provide you with the service), comply with our legal obligations and pursue the legitimate interests provided for by law.

7. Recipients

FEXP employees will have access to your personal data. Only relevant individuals who act within the scope of their job description and have a need to know will have access to your personal data.

We will not share your personal data with local authorities or courts, except where we are required to do so by applicable legislation, a court order or a judicial request.

Employees of third-party providers, as described below, may have access to your personal data. Please note that data processing carried out by third-party providers is beyond FEXP’s control.

Except as mentioned below for sampling services where your company is located outside the EU, FEXP will not transfer your personal data outside the EU. FEXP will transfer your personal data only if you are part of a sampling service as described below, when required to do so by law or by orders of the competent authority.

Additional information for registered users of the FEXP Platform

Your personal data is available through the Platform to your company colleagues who are registered on the FEXP Platform. Your personal data is NOT available to other registered users.

FoodSecuritas, independent residue monitoring schemes and sampling services (“sampling services”): if your company is registered with a sampling service or supplies a customer that has contracted any of FEXP’s sampling services, the sampling organisation in your country will receive your company’s contact details and the details of the contact person.

8. Retention periods for personal data

Registered users of the FEXP Platform

Company administrators on the FoodExperts website must deactivate or deregister company users as soon as appropriate (change of job, termination of employment, etc.) to prevent unauthorised access to information.

Once a user has been deregistered by the company administration, they are no longer visible on the Platform and will not receive any new communications; however, this is a soft (logical) deletion and the data is still stored in the system.

FEXP will permanently (physically) delete the personal data of users deregistered more than six years ago.

9. Online payments

Users of the FEXP Platform can pay online. Online payment data is kept strictly separate from registration data. We do not store payment data. Users who pay online are redirected to the payment gateway for the credit check and the initiation of the payment process. Payment data, such as credit card details, is captured by the payment gateways.

12. Personal data breach notification

As soon as FEXP becomes aware that a personal data breach has occurred, it will notify the AEPD where there is a possibility that the breach entails a risk to the rights and freedoms of natural persons. This notification must be made without undue delay and, where feasible, within 72 hours, including hours falling on weekends and public holidays.

Personal data breaches will be communicated to the natural persons whose personal data has been affected by the breach, following the AEPD’s guidelines on personal data breach notification.

13. Your rights

You have the right to obtain information about any stored personal data concerning you, on request and free of charge. You also have the right to correct, disable and delete your personal data, unless there is a legal obligation to archive it.

14. Updates and other matters

We will update this privacy policy from time to time as necessary. Any changes will be announced on this page. Our users must visit this page from time to time to keep up to date with our data privacy terms.

In the event of any discrepancy between the translations, the Spanish version of this privacy policy will prevail.
